A man in his 50s who tried to kill his brother by calling him over the phone while they were arguing has been sentenced to prison on appeal.
The Criminal Division 1 of the Busan High Court (Deputy Chief Judge Park Joon-yong) dismissed the appeal of Mr. A, who was charged with attempted murder, and upheld the original sentence of four years in prison, the court said on Sept. 27.
Mr. A is accused of attempting to murder his brother, Mr. B (50s-male), on Gamcheon-sa-dori, Saha-gu, Busan, at around 11 p.m. on September 5 last year, stabbing him several times with a weapon and hitting him in the head with a blunt object, but only succeeded in doing so.
Mr. A was on the phone with Mr. B about his mother’s rituals ahead of Chuseok that evening and was angry that Mr. B kept repeating the same words안전놀이터, so he decided to kill him.
He called Ms. B to come to his house and prepared weapons and blunt instruments at home.
After dropping Mr. B off in front of his house, he saw Mr. B arrive with beer and drinks and immediately brandished the weapon. He stopped when Mr. B, who was running away in fear, said, “Brother, I think I’m going to die, please stop.”
The trial court sentenced him to four years in prison, saying, “Fortunately, the victim did not die, but the risk of the crime was quite high and the guilt was heavy, considering the number of wounds he received and the amount of blood he shed.”
Mr. A and the prosecution appealed the sentence.
